Throughout these Terms, "Successful Landscaper", "we", "us" and "our" refer to Landscape Machine Limited.
2. About these Terms
These Terms and Conditions govern your use of the Successful Landscaper website, courses, Academy membership, Lifetime membership, digital products, templates, resources, community and any other products or services we provide.
By purchasing any product, creating an account or using our website, you agree to be bound by these Terms together with our:
- Privacy Policy
- Cookie Policy
- Refund & Cancellation Policy
- Any information displayed during checkout
- Your order confirmation email
If there is any conflict between these Terms and the information displayed during checkout, the checkout information will take priority in relation to pricing, payment plans and the product you have purchased.
3. Who our products are for
Successful Landscaper provides business education for landscapers, gardeners, contractors and other service-based business owners.
You may purchase our products either:
- As a business customer for business purposes; or
- As a consumer purchasing outside your business.
Nothing within these Terms limits any legal rights that cannot legally be excluded.
4. Age Requirements
You must be at least 18 years old to purchase any of our products or services.
If you purchase on behalf of a company or organisation, you confirm that you have authority to enter into this agreement on its behalf.
You are responsible for ensuring all information you provide is accurate and kept up to date.
5. Our Products
We may offer products including:
- Online courses
- Academy memberships
- Lifetime memberships
- Digital downloads
- Templates
- Business documents
- Resource libraries
- Live training sessions
- Community access
- Workshops
- Coaching services
The exact features, pricing and benefits included with your purchase will always be those shown on the relevant sales page and checkout at the time you place your order.
Your confirmation email will confirm exactly what you have purchased.
6. Core Course
The Core Course is normally supplied for a one-off payment.
Unless stated otherwise at checkout, access is provided for twelve (12) months from the date of purchase.
Your purchase includes only the lessons and resources specifically listed on the sales page.
Unless expressly stated otherwise, the Core Course does not include:
- Academy membership
- Monthly live sessions
- Private community access
- Future Academy lessons
- Future document updates
- One-to-one coaching
- Future products released after your purchase
Access automatically expires at the end of your access period unless another product has been purchased which extends access.
7. Academy Membership
The Academy is an ongoing monthly membership.
Membership consists of:
- A one-off joining fee
- A recurring monthly subscription
The amounts payable will always be shown before you complete your purchase.
While your membership remains active, you may receive access to:
- The Core Course
- The Academy resource library
- Business templates
- New monthly training
- Live group Q&A sessions
- Private community access
- Updated resources
- Additional benefits included within your membership
The joining fee covers your enrolment, onboarding and immediate access to the Academy.
If your Academy membership ends, your access to all Academy content, including the Core Course provided through your membership, will also end unless you have separately purchased another product that provides continued access.
8. Lifetime Membership
Lifetime Membership is supplied for a one-off payment.
It includes lifetime access to the products and benefits specifically listed on the sales page when purchased.
Lifetime access means access for as long as Successful Landscaper continues to operate that product.
It does not mean:
- The lifetime of the purchaser
- The lifetime of Dean James
- The lifetime of Landscape Machine Limited
- Permanent use of any particular software platform
We may update, improve, replace or reorganise course content over time.
We may also move courses onto another learning platform where reasonably necessary, provided your purchased access is maintained.
9. Orders
The information on our website is an invitation to purchase and does not constitute a binding offer.
When you place an order, you are offering to purchase the selected product under the terms displayed at checkout.
A legally binding contract is formed when:
- Your payment has been successfully authorised.
- We accept your order.
- We provide access to the purchased product or send your order confirmation email.
We reserve the right to refuse or cancel an order before acceptance where:
- Payment cannot be authorised.
- Incorrect pricing has been displayed due to a technical error.
- Fraudulent or suspicious activity is suspected.
- We are unable to provide the product.
- The purchase breaches these Terms.
If we cancel your order before providing access, any payment received will be refunded in full.
10. Prices and VAT
All prices are displayed at checkout before you complete your purchase.
Where applicable, VAT is included within the advertised price unless stated otherwise.
We reserve the right to change our prices at any time.
Price changes will not affect products that have already been purchased.
Any future changes to Academy subscription pricing will only apply after reasonable notice has been given.
11. Payment
Payment must be made using one of the payment methods offered during checkout.
By placing an order, you authorise us and our payment provider to collect the payment shown at checkout.
You agree to provide accurate:
- Billing information
- Contact information
- Payment details
Receipts and invoices may be provided electronically.
We are not responsible for any exchange rate charges, overseas transaction fees or bank charges applied by your payment provider.
12. Academy Subscription Payments
By joining the Academy, you authorise us to collect your recurring monthly subscription until your membership is cancelled.
Your subscription will normally renew automatically on the same calendar day each month.
If payment cannot be collected, we may:
- Retry the payment.
- Contact you to update your payment details.
- Restrict access to your membership.
- Suspend your account.
- Cancel your membership.
- Recover any outstanding amounts that remain due.
You remain responsible for any payments that became due before your cancellation took effect.
13. Cancelling Your Academy Membership
You may cancel your Academy membership at any time.
Cancellation can be made by:
- Using the cancellation option within your account (where available); or
- Emailing [email protected].
Your cancellation will take effect at the end of your current paid billing period.
After cancellation:
- Future subscription payments will stop.
- Your access will continue until the end of your paid period.
- Access to the Academy will then end.
- Access to Academy resources will end.
- Access to the private community will end.
- Access to live sessions will end.
No refunds will normally be provided for payments already made.
14. Immediate Digital Access
Our products are digital products which are normally made available immediately after purchase.
By purchasing our courses or memberships, you request immediate access to your digital content.
Where applicable by law, you acknowledge that immediate access to digital content may affect your statutory cancellation rights.
Nothing in these Terms affects your legal rights where digital content is faulty, misdescribed or not supplied with reasonable care and skill.
15. Refunds
Our Refund and Cancellation Policy forms part of these Terms.
Unless required by law or expressly agreed by us:
- Payments are non-refundable.
- Joining fees are non-refundable once access has been provided.
- Failure to complete a course does not create a refund entitlement.
- Dissatisfaction with business results does not create a refund entitlement.
- Membership payments already collected are non-refundable.
- Partial month refunds are not normally provided.
- Expired access periods do not create a refund entitlement.
Any discretionary refund issued by us does not create an obligation to provide refunds in future cases.
16. Payment Disputes and Chargebacks
If you believe a payment has been taken incorrectly, please contact us before raising a chargeback or payment dispute.
We will investigate all genuine concerns promptly.
Where a payment dispute is raised, we may temporarily suspend access while the matter is investigated.
Fraudulent or dishonest chargebacks may result in:
- Permanent removal of access.
- Recovery of outstanding amounts owed.
- Recovery of reasonable payment provider costs.
- Refusal of future purchases.
Nothing in this section prevents you from exercising your genuine legal rights where a payment has been taken incorrectly.
17. User Accounts
Your account is personal to you.
Unless you have purchased a team or multi-user licence, you must not:
- Share your login details with another person.
- Allow another person to access your account.
- Share course materials with employees, subcontractors or friends.
- Sell or transfer your account.
- Create multiple accounts to avoid payment.
- Attempt to bypass any security measures.
You are responsible for keeping your login details secure.
If you believe someone has gained unauthorised access to your account, you must notify us as soon as possible.
We reserve the right to monitor unusual login activity and restrict access where reasonably necessary to protect our content and other members.
18. Technical Requirements
You are responsible for ensuring that you have:
- A suitable internet connection.
- A compatible computer, tablet or mobile device.
- An up-to-date web browser.
- A valid email address.
- Any software reasonably required to access our products.
We are not responsible for access problems caused by your internet connection, device, browser, security settings or failure to keep your account details up to date.
19. Intellectual Property
All content supplied by Successful Landscaper remains our intellectual property or is licensed to us.
This includes, but is not limited to:

- Written guides.
- Templates.

- Calculators.
- Documents.
- Graphics.
- Branding.
- Logos.

- Systems and processes.
- Academy resources.
Purchasing access does not transfer ownership of any intellectual property to you.
20. Your Licence to Use Our Content
When you purchase one of our products, we grant you a limited, personal, non-exclusive and non-transferable licence to use the materials.
You may:
- Watch the training.
- Download resources where permitted.
- Adapt templates for use within your own business.
- Use the knowledge gained to operate your own business.
You must not:
- Copy or reproduce our content.
- Sell or distribute our materials.
- Share downloads with another person.
- Upload our materials to another website.
- Use our content to create a competing course.
- Remove our branding or copyright notices.
- Record or redistribute live sessions.

Whilst we moderate the community, we cannot guarantee that every member will keep discussions confidential.
24. Live Training Sessions
Where included, live sessions are provided as educational group events.
Live sessions:
- Are not one-to-one coaching.
- May be delivered by Dean James or another presenter.
- May have limited time available.
- May not answer every submitted question.
- May be rearranged where reasonably necessary.
- May be recorded for Academy members.
We do not guarantee any minimum amount of individual advice or speaking time during live sessions.
25. Educational Information
Successful Landscaper provides practical business education based on real-world experience.
Our courses, templates, resources and training are intended to educate and support business owners.
Nothing within our products constitutes:
- Legal advice.
- Accounting advice.
- Tax advice.
- Financial advice.
- Investment advice.
- Employment law advice.
- Health and safety advice.
- Engineering advice.
- Architectural advice.
- Advice tailored to your specific circumstances.
You should always seek independent professional advice where appropriate before making important business decisions.
26. No Guarantee of Results
Every business is different.
We do not guarantee that purchasing or completing our courses will result in:
- Increased revenue.
- Increased profit.
- More customers.
- Higher-value projects.
- Business growth.
- Financial success.
- Employment opportunities.
- Any specific level of performance.
Your results will depend on many factors outside our control, including your experience, implementation, market conditions, pricing, competition, location and business decisions.

27. Your Responsibilities
You remain solely responsible for all decisions made within your business.
